Canadian Mint taxing musician for using image of penny in protest

Musician Dave Gunning, in a photo from his website (Chris Smith)It's going to take more than a pretty penny for one musician to pay off the Royal Canadian Mint, which has levied a hefty tax against the artist for appropriating an image of the nation's outgoing coinage on his latest album.

Dave Gunning says he wanted to pay tribute to the Canadian penny, which will cease production at the end of 2012, on his upcoming album, "No More Pennies."

However, CBC News reports that once the Royal Canadian Mint heard about the album cover concept, it told Dave Gunning that for every 2,000 albums sold, he must fill out an application asking for permission to continue using the image, then pay $1,200 in fees.

Gunning's album cover shows a person at a lunch counter attempting to come up with enough change to pay for a cup of coffee.

In response to the Mint's fees, Gunning has asked fans to bring pennies to shows on his upcoming fall tour so he can afford to continue selling the album, which debuts Sept. 18. The Mint has waived the fees on the first 2,000 copies but said Gunning must pay for all future sales.

"The Mint has an Intellectual Property Policy in place to protect its IP assets, which includes coin images, and ensure their appropriate use," a Mint spokeswoman told the CBC. "In instances where an approved use is being made for commercial gain (as would be the case with an ad campaign or selling music CDs), royalty fees are applied."

The Royal Canadian Mint has made news several times this year: First with the announcement in March that it would discontinue the penny, then again in April, with the announcement of a glow-in-the-dark quarter.

Ironically, the Royal Canadian Mint found out about the album cover only after an employee there told administrators, reportedly thinking the Mint would be supportive of the gesture.

"Turns out I have a big fan who works for the Canadian Mint," Gunning told the CBC. "He got the idea, 'The Canadian Mint should get behind this. Maybe we could actually sell the CD in our gift shop.'"

Ratings dwindle for MTV's annual VMA show

NEW YORK (AP) ? What a difference a year makes for MTV's "Video Music Awards," and not in a good way.

MTV's annual big event last week was seen by 6.1 million viewers, less than half of the 12.4 million who watched in 2011, when the show was believed to be MTV's most-watched program ever, according to the Nielsen Co., which measures media consumption.

The show wasn't lacking for star power, with performances by Taylor Swift, Frank Ocean, Green Day, Pink and Alicia Keys with Nicki Minaj. But it aired on a Thursday this year, instead of a Sunday, when more viewers tend to be available. MTV also moved up the telecast by one hour to avoid competing with President Barack Obama's speech at the Democratic National Convention, and the 8 p.m. hour is early for MTV's young customers.

Still, MTV said the research company Trendrr said the awards were the top social media event of the year, with more than triple the Internet conversation as last year.

Otherwise, the return of football dominated prime-time television last week. Games between Pittsburgh and Denver (Sunday) and Dallas vs. the N.Y. Giants (Wednesday) topped the ratings with more than 20 million viewers.

The most-watched non-football program of the week was the "60 Minutes" interview with Matt Bissonnette, the former Navy SEAL involved in the killing of Osama bin Laden last year. The former SEAL wrote a book under an assumed name (CBS News did not identify him) and an interview took up the entire CBS News program on Sunday. It was seen by 12.3 million viewers.

The Monday debut of Katie Couric's daytime talk show started strong in the ratings, equaling the highest overnight ratings for a new talk show in a decade ("Dr. Phil," 2002), and beating the debuts of shows featuring Steve Harvey, Jeff Probst and Ricki Lake.

NBC easily won the week's prime-time ratings crown behind football, averaging 10.3 million viewers (6.4 rating, 10 share). Fox had 5.8 million (3.5, 6), CBS had 5.1 million (3.4, 5), ABC had 3.8 million (2.6, 4), ION Television had 1.1 million (850,000) and the CW had 780,000 (0.5, 1).

Among the Spanish-language networks, Univision led with 3.5 million (1.9 rating, 3 share). Telemundo had 1.1 million (0.6, 1), TeleFutura had 670,000 (0.4, 1), Estrella had 170,000 and Azteca had 90,000.

NBC's "Nightly News" topped the evening newscasts with an average of 7.7 million viewers (5.3, 11). ABC's "World News" was second with 7.4 million (5, 10) and the "CBS Evening News" had 5.6 million viewers (3.9, 8).

A ratings point represents 1,147,000 households, or 1 percent of the nation's estimated 114.7 million TV homes. The share is the percentage of in-use televisions tuned to a given show.

For the week of Sept. 3-9, the top 10 shows, their networks and viewerships: Sunday Night Football: Pittsburgh at Denver, NBC, 27.57 million; NFL Football: Dallas at N.Y. Giants, NBC, 23.89 million; "Sunday Night NFL Pre-Kick," NBC, 20.14 million; "Wednesday Night NFL Pre-Kick," NBC, 18.67 million; "Football Night in America," NBC, 12.99 million; "60 Minutes," CBS, 12.32 million; "NFL Opening Kick-Off Show," NBC, 10.68 million; "America's Got Talent" (Tuesday), NBC, 8.93 million; "NCIS," CBS, 7.94 million; "America's Got Talent" (Thursday), NBC, 7.88 million.

GoDaddy's sites up after outage, cause not 'hack'

1 hr.

Web-hosting giant GoDaddy says its service was "fully restored" by 4 p.m. PT Monday, and that despite a purported member of Anonymous taking credit for the outage, it was "not caused by external influences."

"It was not a 'hack' and it was not a denial of service attack (DDoS)," wrote Scott Wagner, interim CEO of?Go?Daddy, in a statement?Tuesday, but rather was?tied to a "series of internal network events that corrupted router data tables.

"Once the issues were identified, we took corrective actions to restore services for our customers and GoDaddy.com. We have implemented measures to prevent this from occurring again."

As the company stressed Monday, "At no time was any customer data at risk or were any of our systems compromised."

The company?hosts hundreds of thousands?of websites, many of them smaller businesses that rely on GoDaddy.

A person on Twitter,?going by the name "Anonymous Own3r," had taken credit for GoDaddy's problems, but wanted to make sure the world knew it was just one Anonymous member, not the group, who was involved: "The attack is not coming from Anonymous coletive [sic], the attack it's coming only from me," Anonymous Own3r tweeted Monday.

Hackers regularly play mind games to make their influence appear greater.?Witness Anonymous' own recent claims that it stole 1 million Apple device identifiers from an FBI agent's laptop. The group, in fact, stole the information from a private Florida company.

Face Claims: Yay Or Nay??

All the reasons against "face claims" I can totally understand, and for the most part, would be in favor for. But in the interest of generating discussion, I'll try and play a bit of devil's advocate here.

Building a roleplay is a lot like making a movie. Having just finished up film school, I've been meaning to wax poetic about this to a more intricate detail, but I'll just try and keep it simple for now. Ultimately, you're wanting to see your dreams, your stories, your characters realized to full potential, animated and moving through "scenes" as clearly by word as they might by picture, in a film.

For me, at least, if I were going to make a rule that the physicality of your character has to be based off of an actor or a public figure, this would be so that when the scenes are written and posted, I can read them and imagine that familiar face.

Think of it like a movie, and then the original novel version. The visual medium is more arresting.

Some people just can't describe how their character looks outside of "blonde hair blue eyes." It takes a very, very firm command of the English language to craft a face, in your mind, out of nothing than just with words. Wide nose. Sloped forehead. Hawkish features. These are things that don't stick with us, as writers, as much, when we're developing a scene. Citing a source of a character as an actor can just keep the iconic image in someone's brain.

Messy features and slender frame, those sorts of things you can have in a character without being so strictly limited to an actor. If "Heath Ledger" is your "face claim" then what Heath Ledger are we talking about? Actors, by nature, can change their appearance and their demeanor, their entire decorum for a role. You're not playing the actor (I know I keep using actors as the example, although Disney characters were cited) - you're playing the character, whatever character you want to create, whatever central conflict.

In a way, it's like Fantasy Football, but for directors, with actors.

I think people are attributing "face claims" with having the character set in stone before you arrive, as a player, and rightly so. If there's an instance where the strict role I will be playing is already defined for me to rigidly adhere to, in addition to having the face, and additional points, then that's where I might find something contrary about this.

There are some roleplayers who want their roleplays to look like television soap operas. And if that's the story, and if that's the narrative pull, then I suppose let it happen that way.

So, on one hand, I can see why players may find their creative juices stymied by "face claims" but on the other hand I can see their use in terms of immediacy, and truly visualizing a character. I also don't find the very nature of having someone's outer appearance as an icon in one's brain to be as crippling as some may think.

Even the best artists draw from models.

A perfect storm of propaganda on health insurance reform ...

A phony report from a phony consumer group, a misleading OpEd by a left-wing legislator and a dose of extreme demagoguery from a BDN columnist have created a well-orchestrated perfect storm of propaganda. But no one should be buying it.

This onslaught of misinformation is meant to discredit the recent health insurance reform passed by the Republican-led 125th Legislature. Although rate hikes under the new Public Law 90 for most Mainers are the smallest in years (many are even seeing reductions), this trio and their comrades are hellbent on sending a different message.

Their goal is to go back to the days of Dirigo Health, extreme health care and health insurance regulations and more Mainers on medical welfare.

The tempest-in-a-teapot started with a ?report? from the well-funded, pro-government-health-care lobbying group, ?Consumers for Affordable Healthcare.? Their ?report? ? although few could seriously call it that ? cherry-picked numbers, ignored positive new trends and is basically spin.

It failed to take into account the recent rate increases by Anthem and Harvard-Pilgrim that are the lowest ever, and this, according to the Bureau of Insurance, is because of PL 90, the law so maligned by ?Consumers? for Affordable Health Care.

The report described higher taxes but didn?t mention that they are only half of the infamous Dirigo Tax, which is now being phased out.

The report cites ?worsened product choices,? but the fact is that there are many new products available. Anthem has announced a new product that covers maternity care, combines out-of-pocket costs and is compatible with tax-advantaged health savings accounts. This product is a direct result of PL 90.

The report also failed to look at past rate increases. According to the Maine Bureau of Insurance, Maine?s average yearly rate of increase in the small-group market over the past 10 years has been around 19 percent. In the individual market, the average increase has been 13 percent.

This is a result of decades of Hail Mary liberal experiments, all of which were cheered on by Consumers for Affordable Health Care. Their brainstorms included community rating, which prevented insurance companies from charging young people less than old people. They instituted mandates that forced expensive policies for coverage many people simply didn?t want to pay for. They championed Dirigo Health, which failed to come close to any of its goals, ate up hundreds of millions in tax dollars and delayed real health insurance reform. Maine?s gigantic medical welfare program, MaineCare, has also had an adverse effect on health insurance rates.

There were more experiments, too numerous to mention, that ultimately forced prices up. We never saw a ?report? from ?Consumers? for Affordable Health Care when all of them failed, when our premiums suffered hyper-increases, when all insurance companies but two left Maine because of our onerous regulatory environment, and when our medical welfare population, percentagewise, became the largest in the country.

Rep. Adam Goode?s misleading and inaccurate OpEd (Sept. 4) is more of the same. While cherry-picking a few rate increases, it completely ignores the facts about the reforms of PL 90 and the positive results. This kind of hyperbole sells well to the Maine People?s Alliance crowd, but working Mainers see through this nonsense.

Columnist David Farmer?s piece (Sept. 5) is an over-the-top, partisan hit job. Its purpose is not to enlighten readers with facts but to destroy with demagoguery. The basis of his piece is the phony report. He exaggerates the results, denigrates Republicans and insinuates malevolence that is unfounded, unfair and insulting. It is meant to frighten. It?s all he has. His side has failed and failed again.

PL 90 is slowly providing relief to Maine?s petri-dish insurance market. The reforms in the new law, which are in complete compliance with ObamaCare, have been well-tested across the country and will bring Maine?s insurance market closer to normalcy.

Among other things, it changes community rating rules, allowing young people to benefit from their low risk. It provides a reinsurance pool so the least healthy can get coverage at reasonable rates. Moreover, it permits more businesses to band together and self-insure. It likewise allows out-of-state purchase of insurance for individuals in 2014.

Maine people have suffered for years as guinea pigs for all of the latest left-wing health care experiments. Correcting this injustice won?t happen overnight. While PL 90 has only been in effect for a few months and has not been fully implemented, good news is coming in already. You?d never know it, however, if you were in the path of this perfect storm of propaganda.

State Rep. Jonathan McKane, R-Newcastle, serves on the Insurance and Financial Services Committee. He is in his fourth term in the Legislature.
